The Supreme Court of Canada has given the permission to precede the 2003 nursing-home fees case of Alberta on Thursday, which was filed by thousands of Alberta seniors.
The class-action lawsuit involves claim of overcharging in nurses homes. The son of former nursing-home resident and the non-profit Elder Advocates of Alberta Society has launched the law suit on behalf of group of Alberta seniors. The seniors said that the government has dramatically inflated the charges of food and accommodation in order to raise medical-expenses.
The top court of Canada found that the lawsuit is worth to proceed on two grounds which include claim of unjust and enrichment.
It was claimed by plaintiffs that fees were used to subsidize basic health-care costs, which should have been given by the government. However, the allegations have not been proven yet in the court.
The court said that suit cannot involve claims of breach of fiduciary duty, bad faith or negligence. The maximum rates have been set for the food and accommodation, while the province does not provide any long-term care facilities itself.
Spokesman, David Eggen asserted, “This ruling should serve as a wake-up call for Alberta Health and Wellness to start providing the affordable long-term care services that our province so desperately needs”.
