Hong Kong Court Rules In Favor of Apple

As per a recently revealed court document, it has been found that Apple is having a hard time to convince its opponent, a Chinese display vendor Proview, to transfer the ownership of China's iPad trademark to Apple. Since the beginning, they have been trying to play tricks with Apple, said a Hong Kong Judge.

He further affirmed that Proview initially demanded US$10 million for the trademark, but the demand was too over the board to be accepted. In which, the court gave injunction power to Apple. Under it, Proview cannot sell its trademark rights to other companies.

If Apple is not able to get the trademark then they would be forced to pay huge sum in form of penalties. There are chances that they also face a ban on its iconic tablet under the iPad name, which is already in China for sale.

Two cases have been filed since the start of the fight over the trademark between the two companies. Initially, Proview announced itself as bankrupt, but told that they still hold the trademark right, which has been extensively being used by Apple.

A court in Shenzhen, China ruled in the favor of Proview in December and asked Apple to compensate with the original owner. This resulted the beginning of second innings between the two organizations, and Apple filed a case against Proview. Apple’s luck worked and a court in Hong Kong supported it in the dispute.

Proview seems to have not lost the battle as the court document read, "The Contracting Defendants (Proview) refused to rectify the mistake and suggested that Apple should pay US$10 million to purchase the China trademarks”. It was only after trademark applications were presented and then the court ruled out in the favor of Apple.
